Acceptable Use Policy (AUP)
Effective Date: April 30, 2025
1. Introduction
This Acceptable Use Policy (“AUP”) governs the use of all hosting services, servers, and network resources (“Hosting Services”) provided by Website Design Agency (WebsiteDA.com) (“we,” “us,” or “our”) to our clients (“you” or “Client”). Adherence to this policy is a mandatory part of our Terms of Service. The purpose of this AUP is to ensure the security, reliability, and integrity of our Hosting Services for all clients.
2. Prohibited Activities
You may not use the Hosting Services to engage in, promote, or facilitate any of the following activities. Engaging in these activities will result in immediate investigation and potential suspension or termination of your services.
- Illegal Content: Hosting, distributing, or linking to any content that violates applicable local, state, national, or international law. This includes, but is not limited to, copyrighted material for which you do not hold the rights, fraudulent schemes, or child pornography.
- Unauthorized Website Hosting: Using your hosting account to host any website other than the single site created for you by Website Design Agency (WebsiteDA.com) as per your Service Agreement. This includes addon domains, subdomains configured to serve different sites, or any form of reselling hosting space.
- Spam and Unsolicited Email: Sending or facilitating the transmission of unsolicited bulk email (spam). All email marketing must comply with the CAN-SPAM Act and other relevant regulations.
- Malicious Software: Distributing or hosting malware, viruses, worms, trojan horses, or any other software intended to cause harm or compromise the security of others.
- Security Violations: Attempting to gain unauthorized access to any computer, system, or network. This includes port scanning, vulnerability scanning, and any other action that could be perceived as a precursor to an attack.
- Resource Abuse: Engaging in any activity that consumes excessive server resources (CPU, memory, I/O) to the detriment of other clients on the same server. This includes, but is not limited to, cryptocurrency mining and running server-side processes not related to the website’s function.
3. Single-Site Hosting Policy
Each hosting plan provided by Website Design Agency (WebsiteDA.com) is intended for the sole purpose of hosting the single website we have designed and developed for you under your Service Agreement. You are strictly prohibited from using your hosting account to host any additional websites, subdomains for separate sites, addon domains, or third-party applications not directly related to the primary website. This policy ensures that server resources are dedicated to the performance and security of the website we manage for you.
4. Resource Usage Policy
Our standard hosting plans are designed to meet the needs of most small to medium-sized businesses. To ensure a high-quality experience for all clients, the following resource limits apply on a monthly basis:
- Disk Space: 8 GB
- Bandwidth: 50 GB
- Monthly Visitors: 100,000
These limits are based on our primary hosting environment, which may utilize services like Cloudflare Enterprise.
5. Actions for Exceeding Resource Limits
We believe in a fair and transparent approach to resource management. Our goal is to support your growth, not to penalize it.
- No Immediate Suspension: We will not automatically suspend your website or services for exceeding the resource limits outlined in Section 4.
- Notification and Consultation: If your website consistently exceeds one or more of these limits, our team will contact you to discuss the situation.
- Renegotiation of Terms: We will work with you to find a suitable solution. This typically involves renegotiating your hosting plan to a higher tier that can accommodate your website’s traffic and resource needs.
- Alternative Hosting Solutions: For clients with specific performance needs or those who consistently exceed standard plan limits, we may recommend migrating your site to an alternative hosting environment. This could include a plan utilizing a LiteSpeed web server and Quic.cloud CDN, which can offer different resource structures, such as unlimited bandwidth and visitors, with a continued limit on disk space.
6. Enforcement
Violation of the Prohibited Activities listed in Section 2 may result in immediate suspension or termination of your Hosting Services without prior notice. For violations of the Resource Usage Policy in Section 4, we will follow the notification process outlined in Section 5. We reserve the right to investigate any suspected violation of this AUP and to take any action we deem appropriate.
7. Modifications to This Policy
We reserve the right to modify this AUP at any time. Any changes will be posted on our website with an updated effective date. Your continued use of our Hosting Services after any modification constitutes your acceptance of the new terms.
